Information to be provided where personal data are collected from the data subject

1. Storage of access data

We collect data on access to the pages of this website and store them as server log files. The legal basis for the temporary storage of the data is point (f) of Art. 6 (1) GDPR. This does not include the users’ internet protocol addresses or any other data that would allow assignment of data to a specific user. This data are not stored together with any other personal data of the user.

The following data are logged:

  • Visited website
  • Time of access
  • Amount of data sent in bytes
  • Source/reference from which you reached the page
  • Browser used
  • Operating system used
  • Search engine used and search terms entered, provided that these are transmitted by the search engine

The collected data are only used for statistical evaluations and to improve this internet offer. We reserve the right to check the server log files retrospectively if there are specific indications of illegal use.

Retention period

The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. This is the case when the respective session has ended in the case of the collection of data for provision of the website.

Possibilities of objection and removal

The collection of data for provision of the website and storage of the data in log files is essential for operation of the website. The user cannot object to this.

Further notices

This website does not use any cookies, Java applets, Active-X-Controls, or any other techniques that are used to track user access behaviour.

2. Storage, processing activities, use and deletion of personal data

It is possible to transmit personal data to us within this website. Personal data are information that can be used to determine your identity. This includes personal data such as your name, address, postal address, phone number, email address, internet protocol address, and cookies. Concerning your personal data, please note in accordance with § 33 of the Federal Data Protection Act (Bundesdatenschutzgesetz; BDSG) that such data will be stored and/or transferred in accordance with the applicable data protection rules.

Right to access, rectification, restriction of the processing of your personal data, data portability and objection; revocation of consent; lodging a complaint

In principle, the General Data Protection Regulation (GDPR) gives you the following rights concerning your data:

  • right to access and information on the data collected concerning you, rectification of your data, erasure of your data, the right to restrict processing of your data, the right to object to collection, storage, and processing activities, and the right to object to data portability,
  • a right to withdraw consent previously given,

In this case, the provision of data is based on the GDPR, the relevant federal and state laws (in particular the Telemedia Act (Telemediengesetz; TMG), the BDSG, and the Brandenburg Data Protection Act) and our town statutes.

The basis and purpose of processing activities is performance of the municipality’s work and the tasks assigned to it by law. This also includes the greatest possible information of the municipal administration about its citizens and the information requested by them.

What does the right of access mean?

This gives you, as the data subject, the right to be informed about the data collected concerning you and their processing within a reasonable time. What does the right to rectification under the GDPR mean?

If you discover that any personal data stored concerning you are incorrect or incomplete, you may request that the data be rectified or completed without delay at any time. You may also request transfer of data stored concerning you to other networks.

Explanations regarding consent and restriction of processing activities

If your personal data have been processed (i.e. in particular collected) based on your explicit consent, you may revoke such consent at any time in accordance with Art. 7 (3) GDPR. However, this shall not affect the lawfulness of the processing of your data until your revocation.

Subject to the conditions of Art. 18 GDPR, you may demand restriction of the processing of your data. This may be the case, e.g., if the authority no longer requires the data, but you need them to assert, exercise, or defend any legal claims and erasure the data would harm your legitimate interests.

You may object to processing activities if

  • you dispute accuracy of the data,
  • processing activities are unlawful,
  • the purpose of the processing activities has been met, but the data are necessary for assertion of legal claims by the data subject, or
  • you have a right to object in accordance with the GDPR.

When must your data be erased in accordance with the GDPR (right to be “forgotten”)?

This is the case if

  • storage of the data is no longer necessary,
  • the data subject has withdrawn their consent to processing activities,
  • the data have been processed unlawfully, or
  • there is a legal erasure obligation under EU or national law.

Personal data are erased by the competent authority when they are no longer needed for implementation and after legal retention periods, e.g. to allow decisions on retroactive changes or in case of illegality, have expired. There is no right to erasure in accordance with Art. 17 GDPR before the deadlines named.

When does your right to be “forgotten” not apply?

This is the case if

  • the right to freedom of expression or freedom of information is overriding, i.e. due to the greater interest of third parties in being informed,
  • storage of the data serves compliance with a legal obligation,
  • public interest in the field of public health is overriding,
  • archiving takes place for purposes or scientific and historical research purposes, or
  • if storage is required for assertion, exercise, or defence of legal claims.

3. Further notices

Apart from this, personal data shall be treated absolutely confidentially and shall only be passed on to any third parties with your separate prior consent. We explicitly inform that data protection cannot be fully guaranteed based on the current state of the art in open networks such as the internet. We appreciate your trust in us and will take the utmost care to protect your personal data. You may also contact us directly if you have any questions.

Please be aware that it is possible for third parties to gain knowledge of your data or to falsify them if data are transmitted over the internet in unencrypted form.

If any newsletters, contact forms, or links to social media are used in connection with this website, which may change as necessary, you will be informed of such use.

If you use the social media, such as Facebook and Instagram, that are linked to our website, your personal data will also be collected, stored, used, and processed by such media.        

Your personal data will also be collected, stored, processed, and used if you order a newsletter or complete a contact form, except if you unsubscribe from the newsletter and ask us to erase the data.

4. Newsletter

If you subscribe to our newsletter, you will receive a confirmation email at the email address you provided. No data shall be collected apart from this email address. The data stored shall not be passed on to any third parties. You may cancel a subscription at any time. We will then remove your email address from the distribution list.
